This afternoon Kurt Frankenburg and Jason Watson of Frankenburg & Jensen pulled out a big defense verdict in the matter of Yasmin Valdez v. Simmons, Second District Court for Weber County #140903592 (See my blog entry from March 27th)

After a grueling three-week Utah medical malpractice trial, an Ogden jury found that the defendant emergency medicine physician had not breached the standard of care in failing to diagnose or otherwise treat a developing spinal cord compression injury in Yasmin Valdez.

In closing argument this morning, plaintiff’s counsel had asked the jury to award over $13,000,000 to the partially-paralyzed plaintiff. But it took the jury only an hour and a half of deliberation this afternoon to reject all claims of malpractice.
