Mike Miller and Kat Abke pulled out an 8-0 defense verdict this afternoon after eleven days of trial in Arnold v. White. (See my blog post for March 22).

Gina Arnold had a colonscopy at age 29, suffered a bowel tear. After nine surgeries, more than $400,000 in medical expenses, and the passage of 18 years, she still is said to be fully debilitated.
 
Life Care Planner Helen Woodard proposed a life plan costing some $4,200,000. Plaintiff’s counsel in closing asked the jury to award nearly 4.5 million in damages. However, after deliberating for a total of only one hour and forty minutes, the jury came back with a unanimous defense verdict in favor of Dr. White, in a Utah medical malpractice verdict for defense.

A year ago another jury in Duchesne returned a defense verdict in favor of co-defendant Dr. Grigsby on statute of limitations grounds. The case has been up on appeal four times; it’s unknown if this defense verdict will lead to a fifth.
